Yes, it is the same thing. Read www.icann.org and specially the parts about the various contracts with DoC (US Department of Commerce) which approves, in writing, every change in the root zone file.

I didn't want to discuss ICANN matters. On the contrary, I wanted to emphasize that ICANN practices are a fixed feature, like gravity, and therefore we should design policies that take this feature into account (if policies are meant to solve real-world problems, that is, and not just to be "elegant").
