Community and Engagement -- RIPE 86 Call for Presentations The RIPE Programme Committee is seeking content proposals from the RIPE community for plenary sessions, lightning talks and BoFs. This proposal recommends setting the minimum assignment size for temporary assignments to a /24 while allowing for a smaller assignment if requested by the End User. This would also allow routing requirements to justify the request for more than a /24 for research purposes. [news] Solidarity with Turkish and Syrian Members and Community

Dear colleagues, I am writing to express solidarity and sympathy with our members and community in Turkey and Syria. Last week saw a natural disaster of monumental proportions in our service region. For those who live and work, and who have family and friends in the affected region, this is clearly a traumatic experience. We are conscious that it is RIPE NCC members who are at this moment providing the Internet services that allow first responders and emergency services to carry out their work, and affected people to access vital information and stay in touch with loved ones. Our thoughts are with you all at this time. For our members in affected areas, we understand that paying invoices, for instance, will be the last thing on your mind, so we ask you not to be concerned and reach out if you need an extension. We will work to support you in this time of need. At the RIPE NCC, we are fortunate to have many excellent staff from the affected countries, and we will do what we can to support them through this period. Should you wish to support the relief effort, I encourage you to find a charitable organisation you support and make a donation. [GM] Call for Volunteers for Executive Board Election Code of Conduct Team

Dear members, This is a call for volunteers from the membership to join the Executive Board Election Code of Conduct Team for the May 2023 General Meeting elections. The Executive Board election of 2023 will be the third to have a Code of Conduct (CoC) for Executive Board Election candidates. I should make it clear that this is a separate Code of Conduct to the RIPE NCC and RIPE community CoCs. This code has been established and is only in effect for confirmed candidates during the election process. An Executive Board Election Code of Conduct Team was also established to evaluate reports of violations of the Code of Conduct. The team for 2022 was made up of seven volunteers and the Executive Board would like to express its gratitude to Sergey Myasoedov, Sebastian Becker, Nat Morris, Reza Hajiahmadi, Jan Žorž, Cynthia Revström and Erik Baïs who carried out this important work. The Executive Board would now like to ask for volunteers from the membership to be on the Executive Board Election Code of Conduct Team for the May 2023 election. The task of this team will be to evaluate any reports of violations of the election Code of Conduct by candidates. If the team confirms that a violation of the election Code of Conduct has taken place, disqualification of the candidate in question can take place. If you are willing to participate in this role, please send a mail to <agm(a)ripe.net> by *Friday, 24 February 2023*. The Board will appoint members of the team from the list of those that volunteer. Members should not volunteer if they expect to become candidates in the election. [news] Invoices and Redistribution for 2023

Dear members, We are finalising our invoices for this year. These will be issued to most members next week. Members who are under evaluation for possible sanctions will be contacted separately about their invoices. This year, we will not be issuing printed invoices. Invoices will only be available online in the LIR Portal. This is due in part to the unreliability of postal delivery in some parts of our service region. However, we also see a move to digital invoices as a positive step in our efforts for environmental sustainability. If you require a printed version of your invoice, please send a message to <billing(a)ripe.net>, and we will send the printed version to you. You may also print the invoice yourself should you need printed invoices for local authorities. Redistribution 2022 At the RIPE NCC General Meeting in October 2022, members voted to redistribute the 2022 surplus to members in 2023. However, there is no surplus recorded in our to-be-audited year-end figures, so there will be no 2022 redistribution added to your invoices. Although the RIPE NCC was within its operating budget, unfavourable market circumstances resulted in a reported unrealised financial loss in our investment portfolio. Additionally, our inability to collect money from ultra high-risk countries also means that our reported income is lower than expected, and therefore there is no 2022 surplus to redistribute. However, there remains a small surplus from 2021 to be redistributed. This remainder is 180K EUR and is explained by closures, bad debt and redistributions being based on estimates before the final audit of the financial year. This will result in a small redistribution (8 EUR on average per LIR) for members who paid fees in 2021, and you will see this on your invoice. We will provide more detailed information on this in the RIPE NCC Financial Report 2022, which will be published in April this year. Dear RIPE NCC members, The RIPE NCC Executive Board held its 163rd Meeting on 14-15 December 2022. The minutes from the meeting are later than planned and are now available. Minutes of the 163rd Meeting: https://www.ripe.net/about-us/executive-board/minutes/2022/minutes-163rd-ex… The Executive Board publishes the minutes of its meetings so that the workings of the Board and the decisions it makes are transparent to the membership that it represents. The following is a summary of the main items from the meetings. Further details are available in the minutes. ----------------------- Main Items ----------------------- - The Board reviewed the deliverables of the external investigation into an allegation from a RIPE NCC staff member of bullying and intimidating treatment by an Executive Board member. The investigation was tasked to identify whether there have been violations of the RIPE NCC Code of Conduct from the moment the RIPE NCC Code of Conduct was applicable to the person in question, i.e. from the moment the person in question was elected as a member of the RIPE NCC Executive Board. From the deliverables of the external investigation, no violation of the RIPE NCC Code of Conduct was identified. The Chair will follow up with a separate meeting with the board member in question. The Managing Director and HR Director will communicate the outcome of the investigation to the employee and all RIPE NCC staff before the publication of the minutes. - The Board requested the Managing Director to investigate whether it is possible to amend the Articles of Association in order to allow the Board to temporarily suspend board members until a final decision is made by the GM. The Board also requested to investigate mechanisms for the assessment of Executive Board candidates before an election. - I shared an update on the RIPE NCC’s objectives and provided details on the Objectives and Key Results (OKR) methodology. The meeting contained updates on developments and OKR results for HR, Community & Engagement, the Registry, Information Technology, and Information, Security and Compliance. - I gave a status update on the latest developments in AFRINIC. The Board expressed their concerns for the lack of development and resolution of the issues. - The Board discussed the impact analysis of four scenarios which apply temporary restrictions on Ukrainian resource holders and resolved to allow Members and End Users to request the prevention of their resources from being transferred for a period of six months (until 1 July 2023). - Athina Fragkouli shared a follow-up analysis on corporate governance and legal matters of the potential corporate restructure. - Athina also suggested small amendments to the terms and conditions of the IPv4 Transfer Listing Service. The amendments clarify that members must publish only IPv4 addresses eligible for transfer and that the RIPE NCC may remove the publication of IPv4 addresses that are not eligible for transfer. - The Board agreed with the notarisation of documents in specific cases - The Board discussed the various arguments that support a request to use XK as the Kosovo country code in the RIPE Database and in the RIPE NCC membership application process. - RIPE Chair Mirjam Kühne shared her report on developments in the RIPE community. - I explained the changes from the draft version of the Activity Plan and Budget 2023 to the one published at the October 2022 GM. - The Board held an executive session with Hans Petter to assess the results of 2022 and provide feedback and recommendations. ---------------------------- Resolutions Adopted ---------------------------- - The RIPE NCC Executive Board approves the minutes of EB#161 and EB#162. - The RIPE NCC Executive Board resolves to allow Members and End Users (represented by their sponsoring LIRs) to request the prevention of their resources from being transferred for a period of six months (until 1 July 2023). - The RIPE NCC Executive Board also resolves that all transfer requests from Ukraine, including the pending ones, are only allowed if accompanied by notarised supporting documents. - The RIPE NCC Executive Board approves the proposed amendments to the IPv4 Transfer Listing Service Terms and Conditions. - The RIPE NCC Executive Board approves the proposed amendments to the RIPE NCC Certified Professionals Service Terms and Conditions. - The RIPE NCC Executive Board approves to request notarisation of documents supporting transfer requests above a certain risk level determined by the RIPE NCC. - The RIPE NCC Executive Board approves the RIPE NCC Activity Plan and Budget 2023 and the publication of the document. [news] Update on Measures to Protect Ukrainian Networks

Dear colleagues, I want to update you on measures to protect the resources of RIPE NCC members in Ukraine following my last email in October[1]. After discussions with our Executive Board, we are now ready to begin implementation of a ‘voluntary registry lock’ in the LIR Portal. This will be available for all RIPE NCC members, including those in Ukraine, on an opt-in basis. The lock will allow members to prevent their resources from being transferred for a defined period. We expect technical implementation to be completed before the end of the year. The authority to implement this feature comes from a Board resolution that was passed at the 163rd RIPE NCC Executive Board Meeting on 14-15 December 2022. The effect of the resolution is that Members and End Users (represented by their sponsoring LIRs) will be allowed to request the prevention of their resources from being transferred for a period of six months. And all transfer requests from Ukraine, including the pending ones, will only be processed if accompanied by notarised supporting documents. We will contact all Ukrainian members with pending transfers to make sure they are aware of these requirements. And for members with pending transfers who wish to make them before the end of the year, we will not charge fees for 2023 if these extra requirements mean that the LIR accounts in question cannot be closed by the end of 2022. The Board made this resolution taking into account: - The concerns expressed by Ukrainian members at the RIPE 85 Meeting in October 2022 - The RIPE NCC’s commitment to be neutral and impartial - The time needed for the formation of a permanent solution addressing these concerns through the Policy Development Process (PDP) - The RIPE community’s support to accommodate a temporary solution This resolution comes with an expiry date of 1 July 2023. We hope that the RIPE community will use this time to agree on a policy proposal that gives us a clear mandate to provide this lock as a lasting solution to all members who see the need for it. Our Policy Officer is available to offer guidance and administrative support to get the proposal through the RIPE Policy Development Process. From comments at RIPE 85, we understand that some people do not think this should be a policy matter. However, as we explained at that meeting, the RIPE NCC cannot limit the transfer rights of paying members without either a solid legal basis or a clear mandate from the RIPE community. It is in this context that we must note that the lock will not prevent resources from being transferred in cases of merger or acquisition. It will also not prevent transfers in cases where a bankrupt company goes into liquidation. Finally, in my last email, I said that requests from Ukraine would receive the ‘highest levels of due diligence’, and I want to explain what this means. In recent years, we have developed a framework that describes what information our staff will ask for when handling requests. By applying the strongest approach within this framework, we will be going beyond our standard requirements and asking to verify additional documents. With the passing of this resolution, transfers will follow the process outlined here and will not be escalated to the Managing Director for approval. We hope that our Ukrainian members will understand that this is part of our efforts to protect their resources. As mentioned above, we will share more specific information on the registry lock before the end of the year – including how it can be activated and by whom, and what it does and does not restrict. The following is a summary of the main items from the meetings. Further details are available in the minutes. ----------------------- Main Items ----------------------- - It was decided to proceed with the deployment of the ‘Publish in Parent’ service of RPKI as it currently stands after Felipe Victolla Silveira consulted stakeholders. [news] Measures to Protect Ukrainian Networks

Dear colleagues, At last week’s RIPE 85 meeting in Belgrade, the RIPE community discussed ways to further protect the resources of Ukrainian networks. I want to provide a brief summary of what we heard at RIPE 85 and outline what we will be doing next. At the meeting, there seemed to be general support for the following points: - Apply a temporary freeze on all transfers from Ukrainian networks until a better solution can be found - Implement a way for members concerned that they are at risk to lock their resources and prevent them from being transferred for a set period of time - The RIPE NCC should be able to act on urgent matters without going through the policy development process, especially as policy changes will take several months to complete the RIPE PDP even if there is unanimous support - Ukrainian operators do not want government to take a more active role in terms of approving registry updates - The RIPE NCC should move on this matter with urgency However, we do note that there have been further comments on the mailing lists arguing against a blanket freeze on transfers. As an immediate response, all transfer requests from Ukrainian networks will be escalated to me until further notice. We will of course continue to apply the highest levels of due diligence when reviewing these requests. This will add some amount of delay, which I think is entirely appropriate under the circumstances and given the seriousness of the concerns that have been raised. This should be seen as a temporary measure which has the advantage of being something we can apply straight away. RIPE NCC staff are currently investigating additional short-term measures and we will update you on our next steps after these have been discussed with the Executive Board. Dear colleagues, The RIPE NCC General Meeting October 2022 took place from 26-28 October 2022. A total of 1,269 members cast their votes. The following resolutions were approved at the General Meeting: Resolution 1 ‘The General Meeting approves the redistribution of the excess contribution paid in 2022 by redistributing the RIPE NCC 2022 surplus to the membership in 2023.’ Resolution 2 Proposal to implement amendments in the Dutch law ‘The General Meeting, in accordance with Article 21 of the Articles of Association, adopts the amendments to Articles 10 and 11.5 of the Articles of Association as proposed and announced by the Executive Board on 28 September 2022. Furthermore, the General Meeting instructs and authorises the Executive Board to perform or to have performed all that is required to have the amendments executed before a Dutch civil law notary.’ Resolution 3 Proposal to give the Management Team the authority to call for Executive Board elections ‘The General Meeting, in accordance with Article 21 of the Articles of Association, and provided Resolution 2 is adopted, adopts the amendments to Article 10.1 of the Articles of Association as proposed and announced by the Executive Board on 28 September 2022. Furthermore, the General Meeting instructs and authorises the Executive Board to perform or to have performed all that is required to have the amendments executed before a Dutch civil law notary.’ Resolution 4 Proposal to remove the requirement to have paper ballots for RIPE NCC General Meeting voting ‘The General Meeting, in accordance with Article 21 of the Articles of Association, and provided Resolution 2 is adopted, adopts the amendments to Article 18.5 of the Articles of Association as proposed and announced by the Executive Board on 28 September 2022. [news] Update on Independent Investigation of Allegations by RIPE NCC Staff Member

Dear RIPE NCC members, I want to give you an update on the independent investigation that we initiated in May this year into allegations of bullying of a RIPE NCC staff member by a member of the Executive Board. In short, the investigation is still ongoing. We understand that people want to see a conclusion to the investigation, and we share that desire to see an outcome. However, the most important aspect of this matter is to have a fair and independent investigation that leads to the right outcome. Several legal issues and difficulties in arranging meetings with various parties over the summer have been the main causes of delay. There will be no action taken until the independent investigation is complete. And to clarify, until we get an outcome from the investigators, no one is or will be placed under administrative leave or will be asked to step down from a position.
